GENERAL CONDITIONS OF THE CONTRACT

1. Objective of the Service
With the signature of the present deprived writing the Why Not Inc., settled in Marsala Via Pascasino, 14, provides the user licence of the denominated service "Italybookings System" as well as the conditions related to the booking applications that the system directly sends to the receptive structure. All the conditions subsequently reported have for object the norms of use of the service offered by Why Not inc.
2. Bookings
The applications for informations or bookings sent by the users,will be directly received by the receptive structure, by means of a form made available by the system that the client should fill out with all the required data, without any intermediation from us, as ItalyBookings.com has the purpose of facilitating the correspondance between the demand and the offer. It will only be the receptive structure to answer to the client and the booking must be confirmed directly by the same one, by e-mail, to the address that the client has written in the application form.
3. Annual Canon
Annual canon is established. 
4. Responsibility of Italybookings.com
The Why Not Inc. by the automated Italybookings system, commits to always maintain efficient and updated the service itself, and to furnish the due assistance and all the necessary information to the client. In the case in which the service suffers interruptions due to problems of the Hardware or of the Software or to improve the system, as well as to accidental and exceptional events, the Why Not Inc. will look for in all the possible ways, to reduce to the minimum the interruption and bad operation periods. The Why Not Inc., in no case, could be retained responsible for the malfunction of the service due to problems of the telephone lines, the electricity lines and of Internet for breakdowns, overloads, interruptions or any other action, omission, condition, or for the lossing of earnings, out of its the control. Therefore no damages indemnity could be requested to the Why Not Inc.
5. Responsibility of the Receptive Structure
Italybookings.com has been conceived for furnishing complete, truthful and reliable information to the internet clientele. In the case in which the receptive structure puts on-line, non truthful or non reliable data, the Why Not Inc. has the right to suspend the service or to cancel the contract. The Receptive Structure is the only one responsible for of the truthfulness of the offered products and their description, and commits to respect with rigor and punctuality as much as promised, also, he is the only one responsible for the sold products if in order as in qualitative terms. The Receptive Structure can not give to others, the way of using the service of Italybookings.com for any purpose that is contrary to the public ethic and to the public order or that can cause nuisance, offense or damage to the public and private quietness,  in a direct or in an indirect way. It is also forbidden, the use of the Italybookings.com services for reasons that contravene the effective laws of the Italian state or of any other state, as well as for the diffusion and publicity of erotic and pornographic material. The verifying of the above exposed prohibition statements, constitutes receding clause expressed in the contrac to the senses of the art.1456 of the civil code. The Client, besides, integrally exonerates the Why Not Inc. of any civil and penal responsibility due to the illegitimate and inappropriate use of the service. The Why Not inc. provides EXCLUSIVELY HOSTING and TELEMATIC SERVICES, and does not assume any responsibility about the services offered by the structures.   
6. Cancellation of the contract
The cancellation of the present contract, to the senses of the art. 1456 of the civil code, may happen for one of the following hypotheses:  
6.1. Nonfulfillment of anyone of the commitments or of the obligations settled in the paragraphs of the present contract and in fact of those indicated in the articles 5, 6.1.  
The Why Not Inc. has the right to suspend the service or to cancel the contract in any moment and for any reason without previously notification neither obligation.
7. Access to the directory of Italybookings.com 
Since the receptive structure is authorized to access the server of Italybookings.com, to the directory to it reserved, each responsibility consequence of its actions is assumed, regarding cancellations, missed modifications and all that can create faulty operations. Besides, the receptive structure commits to control the inserted data personally, being assuming all the responsibilities of its operations, understood the possible economic damages due to the inclusion in the directory to it reserved of any type of file infected by virus. On the other hand the Why Not Inc. has the right to control the server and to proceed to the elimination of eventual virus or infected files, without giving previous communication to the receptive structure. 
8. Duration and Expiration 
The present contract lapses from the date of recording in the database of Italybookings; is valid for 12 months and cannot be tacitly renovated. 
9. Generals  
The present contract annuls and replaces any precedent agreement between the parts regarding the object of the present contract. For all that is not specifically specified in the present contract, it abides by the effective norms of the civil code. For each question or controversy arisen in order of the present contract are exclusively competent the forum of Marsala. I declare of having examined the general conditions of the contract and of accepting all the contract clauses above exposed, integrally.
